These terms are an agreement between you and CKC Technologies Ltd (“we”, “us”) covering your use of the Pet Memorial app for iPhone and iPad. By downloading or using Pet Memorial, you accept them.

 

1. Your licence to use the app

We grant you a personal, non-transferable, non-exclusive licence to use Pet Memorial on Apple devices that you own or control, in line with the Apple Media Services Terms and Conditions.

You may not copy, redistribute, sell, rent, reverse-engineer or attempt to extract the source code of the app, except where that restriction is prohibited by law.

2. Your content is yours

Everything you put into Pet Memorial — photos, videos, names, dates, captions, albums — remains entirely yours. We claim no ownership of it, no licence over it, and no right to use it. We could not use it in any case: it never reaches us. See the Privacy Policy.

You are responsible for having the right to use the photos and videos you add.

3. Back up your memories

Please read this part carefully, because it matters more here than in most apps.

Pet Memorial stores your data on your device, and syncs it through your own iCloud account if you have that enabled. We keep no copy. That means:

• If you delete the app without iCloud sync enabled, your data is gone and we cannot recover it
• If you delete a pet, its memories, albums and reminders are deleted with it, permanently
• If you lose your device and had no iCloud sync or device backup, your data is gone

We are not able to restore anything for you, ever. There is no server-side copy to restore from. We strongly recommend keeping iCloud sync enabled, keeping a device backup, and exporting pets you particularly care about as .petmemorial files kept somewhere safe.

4. Free and Premium

Pet Memorial is free to use for your first pet, including 10 photos or videos, one album and one reminder. Slideshows, AirPlay, iCloud sync, and exporting or importing .petmemorial files are available on the free tier and are not restricted.

Pet Memorial Premium removes those limits: unlimited pets, photos and videos, albums, and reminders.

Prices are in GBP and may vary by region; your local price is always shown in the app before you subscribe.

5. Subscription terms

• Payment is charged to your Apple Account at confirmation of purchase
• Subscriptions renew automatically at the same price for the same period unless auto-renew is turned off at least 24 hours before the end of the current period
• Your account is charged for renewal within 24 hours before the end of the current period
• You can manage or cancel your subscription in your Apple Account settings at any time. Cancelling stops future renewals; it does not refund the current period
• Deleting the app does not cancel a subscription

If your subscription ends, nothing you created is deleted. Your pets, photos, albums and reminders all remain. You will simply not be able to add beyond the free tier limits until you subscribe again.

Refunds are handled by Apple, not by us. We cannot issue refunds for App Store purchases. Request one at https://reportaproblem.apple.com.

6. What the app is not

Pet Memorial is a personal keepsake and journal. It is not a veterinary, medical, grief-counselling or bereavement-support service, and nothing in it is professional advice of any kind.

If you are struggling with the loss of a pet, please consider speaking to someone. Pet bereavement support services exist in most countries, and your vet can usually point you to one.

7. Availability

We work to keep Pet Memorial working well, but we do not guarantee that it will be uninterrupted or error-free. Features may change, and features may be removed in future versions. Because the app works offline and stores your data locally, an interruption to any service of ours does not affect your access to your own memories.

8. Liability

To the fullest extent permitted by law, the app is provided “as is” without warranties of any kind, and we are not liable for any indirect or consequential loss, or for any loss of data.

Nothing in these terms limits our liability for death or personal injury caused by negligence, for fraud, or for anything else that cannot be limited under the law of your country. If you are a consumer, you keep all the statutory rights the law of your country gives you, and nothing here reduces them.

9. Apple

Apple is not a party to these terms and has no obligation to provide support for Pet Memorial. Apple is not responsible for the app or its content. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

10. Ending the agreement

You may stop using Pet Memorial at any time by deleting it. We may end this licence if you materially breach these terms.

11. Governing law

These terms are governed by the laws of England and Wales. If you are a consumer resident elsewhere, you keep the benefit of any mandatory consumer protections available in your country of residence.

12. Changes to these terms

We may update these terms as the app changes. The date at the top shows when they were last revised, and material changes will be noted in the app’s release notes.
